WARNING

The ticket holder, on behalf of self and any accompanying minor(s) (“Holder”), assumes all direct and indirect risks and danger incidental to the game of baseball and/or related events to which this ticket admits the Holder, whether such risks occur prior to, during or after the actual playing of the game, including but not limited to the danger of being injured by thrown bats; thrown or batted balls or other equipment; players or officials entering the spectator areas; pre- and post-game activities; use of recreational areas; participation in on-field and in-stadium activities, ceremonies, or promotions; lost, stolen, damaged personal property; and any incidents or accidents associated with crowds of people. The Holder agrees that Padres, LP (the “Padres”), Seattle Mariners (the “Mariners”) (collectively, “Clubs”), the City of Peoria, Arizona (the “COP”), Tickets.com, and Major League Baseball (“MLB”), participating major league clubs, their agents, players, staff and other individuals related to the games or events are not liable for injuries or property losses resulting from any such causes.

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE CLUBS AND THE PEORIA STADIUM OWNER/OPERATOR.

Holder (as defined at the conclusion of this paragraph), on their behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Clubs (as defined below) and/or the Ballpark (as defined below) owner/operator, including, without limitation, any policies and protocols regarding security, bags, fan conduct and health and safety, currently available at www.peoriasportscomplex.com, all of which, due to the evolving nature of the COVID-19 pandemic, may continue to be updated from time to time between purchase of this ticket and the date of the game or event governed by these terms ("Event"), and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable laws and policies of federal, state, city and local authorities. A “Holder” as used herein is the ticket holder, on their own behalf and on behalf of any accompanying minor. An “Accompanying Party” as used herein is any accompanying party for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting these terms).

NOTICE

By using this ticket, Holder agrees to all terms and conditions herein this ticket disclaimer ("the Agreement"). Key Agreement terms are summarized herein (the Agreement controls if any conflict):

This ticket is a revocable license to attend the event shown. As a condition of this license, the Holder agrees to comply with all rules and requirements of Peoria Stadium. Admission may be refused or Holder ejected at the sole discretion of Padres, Mariners and COP subject to refund. Refund will not be granted if the Holder fails to comply with the Agreement or is deemed to be disorderly.

This ticket must be presented for admission to Peoria Stadium, retained by the Holder during the baseball game and/or related events, and shown to any Peoria Stadium representative upon request. If the Holder requires a seat with disability access, the Holder may contact the Peoria Stadium ticket office to exchange this ticket for an accessible seat location (subject to availability).

Guests may not bring the following items onto Peoria Stadium premises: weapons, controlled substances, outside alcohol, large containers, or beverages other than sealed/colorless/non-carbonated water bottles, baby bottles, unopened soft-sided single-serve containers, empty plastic sports bottles or medically necessary items. Peoria Stadium reserves the right to limit backpacks, large bags and similar items. The Holder consents to reasonable search of all items carried onto the premises.

If this ticket is sold by or purchased from anyone not authorized by the Padres, Mariners or COP seller and buyer assume all legal and financial risks associated with the transaction. Tickets sold by unauthorized persons or companies could be lost, stolen, or counterfeit, will not be honored and the Padres, Mariners and COP are not responsible for losses due to unauthorized ticket transactions. This ticket may not be used for advertising promotions (including contests and sweepstakes) or other trade purposes without the express written permission of the Padres, Mariners and/or COP. This ticket may be replaced at the sole discretion of and subject to the policies of the Padres, Mariners, and/or COP.

The Holder agrees not to transmit or aid in transmitting any description, account, picture, reproduction or other depiction, in any media now or hereafter existing, of all or any part of the baseball game or related events to which this ticket admits the Holder. Breach of the foregoing may result in legal action against the Holder.

This ticket grants MLB, Padres, Mariners, COP and anyone authorized by the listed entities irrevocable permission to use the Holder’s voice, image or likeness for any live or recorded video display, broadcast or other transmission, photograph, reproduction or other depiction in any media now or hereafter existing for any legal purpose without the consent of the Holder.

ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL AND BINDING ARBITRATION.

POSTPONEMENT/RAINOUT EXCHANGE

In the event a regulation game (4 ½ innings) associated with this ticket is postponed or not completed, this ticket becomes a rain check that must be presented to the Peoria Stadium Ticket Office for exchange to another Spring Training game at Peoria Stadium within the current Spring Training Season. All exchanges are based on the value of the ticket subject to limitations set forth by the Padres, Mariners, and COP and subject to seat availability for the selected game. To receive a refund of a postponed game, ticket(s) must be returned per the original method of purchase, and received no later than May 1st of the year the Spring Training game was originally scheduled to be played. FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times while infected. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if within fourteen (14) days preceding the Event, they have:

(1) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

(2) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

(3) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Peoria Stadium and its surrounding areas, including parking lots ("Ballpark"). By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.

RELEASE OF LIABILITY, INDEMNIFICATION AND COVENANT NOT TO SUE

HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, AGREE TO INDEMNIFY, DEFEND, WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND COVENANTS NOT TO SUE THE CITY OF PEORIA, ITS EMPLOYEES, VOLUNTEERS, OFFICERS, AND AGENTS AND THE MLB ENTITIES (AS DEFINED BELOW) (THE "RELEASED PARTIES") WITH RESPECT TO ANY CLAIM, LOSS, LIABILITY, COSTS, EXPENSE (INCLUDING ATTORNEY'S FEES) OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE BALLPARK OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (a) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (b) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY. “MLB Entities” as used herein are Padres, LP, Seattle Mariners (collectively, the “Clubs”) and the other Major League Baseball Clubs (together with the Clubs, the “MLB Clubs”), MLB Advanced Media, L.P., the Office of the Commissioner of Baseball (“BOC”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the MLB Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable.

BY ATTENDING THE GAME, HOLDER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF HOLDER WILL NOT OR CANNOT AGREE TO THE AGREEMENT ON BEHALF OF MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE GAME WITH SUCH MINOR(S).
